Usage Policy

Below you will find our usage policy. This defines the ways in which you may use ChorePay and what constitues account suspensions or expulsions.

1.Introduction.

ChorePay, Inc. ("ChorePay"), operates this website and the services it makes available thereon ("Website"). By accessing the Website you agree to these Terms of Use ("Terms of Use" or "Terms"). ChorePay may modify, add, or delete portions of these Terms at any time by posting the changes on this page. Your continued use of the Website after any such changes have been made means you agree to such changes. If ChorePay makes any material changes to the Terms, it will indicate, at the top of this page, the date these Terms were last revised. Some Website services are continually evolving. ChorePay may change or even eliminate them with no notice, at its sole discretion.

2.Privacy and Acceptable Use Policies.

These Terms incorporate by reference ChorePay's Privacy Policy located here. Please read the terms of the Privacy Policy carefully as you agree to them when you agree to the Terms.

3.Your Accounts

Setting Up an Account. To participate in the Website services, you must be a parent or legal guardian and administer the accounts of your participating family members ("Family Account Administrator"). You can create a family account ("Family Account") by providing the required information and paying any applicable fees. The Family Account Administer may then create personal accounts ("Sub-Accounts") for each individual who participates in the Website services. ChorePay automatically creates one Sub-Account for the Family Account Administrator. By accessing the Website and creating a Family Account, you represent and warrant that: (a) all information provided in connection with your Family Accounts and Sub-Accounts is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are old enough to create binding, legal agreements in your jurisdiction; (d) you will only grant access to your Sub-Accounts to members of your family and then only in accordance with this Agreement; and (e) your and your family's use of the Website will violate no applicable law, regulations and will comply with these Terms.

Account Security. When you create a Family Account, you will be asked to choose a user name and password. You will also be asked to select the user names and passwords for each Sub-account that you create. You are responsible for your Family Account and each Sub-Account that you create and all activity that occurs under those accounts. You will: (x) maintain the confidentiality of your passwords; (y) refrain from permitting non-family members from using any of your Sub-Accounts; and (z) immediately notify ChorePay if you suspect any unauthorized use of your accounts. You are solely responsible for any and all use of your Sub-Accounts by any persons, including children and you are responsible for all data posted under your Sub-Accounts and by your Sub-Account holders otherwise on the Website. Accordingly, ChorePay strongly encourages you to use the Website together with your family and monitor all Sub-Accounts carefully.

ChoreBucks. After you open a Family Account, you may purchase ChoreBucks to be distributed to your Sub-Accounts pursuant to criteria you establish. ChoreBucks may be redeemed with ChorePay's merchant partners in ChorePay's virtual mall, may be donated to one of ChorePay's partner charities, or may be otherwise saved or spent pursuant to the functionality of the Website. The accounting of the amount of ChoreBucks you have in your account will be pursuant ChorePay's records, and such records will prevail in the event of any related dispute.

Returns. If you use ChoreBucks to purchase merchandise in ChorePay's virtual mall, and you wish to return merchandise within 14 calendar days of purchase, ChorePay will make commercially reasonable efforts to facilitate the return, subject to ChorePay's then-current return policies. Release. If you have a dispute with one or more of our merchant partners regarding merchandise purchased with ChoreBucks, you understand and agree that such dispute is between you and the applicable merchant partner. You release ChorePay (and its officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

4.Your Use of this Website.

All intellectual property rights in and to the images, text, logos, marks, data, audio, video, design, codes, layout, "look and feel", and other content that is included on this Website ("Content") is owned by ChorePay or its licensors. All elements of the Website, including the Content, are protected by copyright, trade dress, moral rights, trademark, and other intellectual-property and third-party rights. You may not download, upload, copy, republish, post, (re)transmit (including by deep-linking), or distribute the Content for any reason without a separate, written agreement between you and ChorePay expressly granting such permission except that you may make one copy of the Content for your own personal, non-commercial use.

If you have registered for any ChorePay services, ChorePay may terminate your registration if you have, in ChorePay's sole discretion, violated these Terms of Use, exhibited unlawful behavior, or otherwise behaved inappropriately. Specifically, and without limiting the generality of the foregoing, you may not, in connection with the Website or the information thereon:

  • use the Website for any purpose other than your personal, non-commercial purpose;
  • use the Website for any illegal or immoral activities;
  • harm or advocate the harming of humans or animals;
  • interfere with the safety or well-being of other users;
  • engage in advertising or solicitation of others to buy or sell any products or services through the Website;
  • engage in any commercial advertising;
  • introduce software, automated agents, or bots to the Website to produce multiple accounts, perform data-mining, or to improperly augment or otherwise change your scoreboards or points;
  • impersonate any person or entity, harass, or stalk any person;
  • express or imply that you or your actions are endorsed by ChorePay;
  • remove any copyright, other proprietary-rights notices, banner advertisements or other content displayed on the Website;
  • interfere with or disrupt the Website or the servers or networks connected thereto;
  • transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware or telecommunications equipment; or
  • reverse engineer, decipher, decompile, or otherwise disassemble any of the technology underlying the Website.
  • 5.Third-Party Websites and Third-Party Applications.

    You may be able to link from this Website to third-party websites, including merchant-partner websites, that take you outside of ChorePay's Website ("Linked Sites"). ChorePay has no responsibility for the information, content, products, services, advertising, code or other material that may be provided through the Linked Sites. You may also be able to link from this Website to software applications that are owned and operated by third parties ("Third-Party Applications"). ChorePay has no responsibility for the information, content, products, services, advertising, code or other material, which may be provided through Third-Party Applications. With regard to both Linked Sites and Third-Party Applications, please use common sense as you navigate the Web, be aware when you leave this Website, and review the terms of use and privacy policy for each Linked Site that you visit and each Third-Party Application that you use.

    6.Termination.

    If you have registered with ChorePay, you may terminate your account and these Terms of Use at any time by sending e-mail to: staff@chorepay.com. If you have not registered with ChorePay, you may terminate these Terms of Use at any time by permanently discontinuing your use of this Website. ChorePay may terminate your account and/or use of this Website at any time for any reason with or without notice to you. YOU UNDERSTAND AND AGREE THAT WHEN YOUR ACCOUNT IS TERMINATED, CHOREPAY WILL NOT REFUND AMOUNTS PAID FOR THE PURCHASE OF CHOREBUCKS. Rather, ChorePay will issue you a Visa gift card for the dollar amount remaining in your account.

    ChorePay is not responsible for any incorrect or inaccurate content posted by third parties on the Website or in connection with therewith. ChorePay is not responsible for the conduct, whether online or offline, of any user of the Website.

ChorePay is not responsible for verifying any amounts, calculations, sums, or transactions. Any points, tracking symbols, or icons that you use on the Website are licensed to you on a temporary basis only. Your use of the Website is entirely at your own risk.

    8.Limitation of Liabilities.

In accordance with the Digital Millennium Copyright Act ("DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, ChorePay will respond expeditiously to notices of alleged copyright infringement that are duly reported to its Designated Copyright Agent identified in the notice below. ChorePay will disable and/or terminate the accounts of users who are repeat infringers. If you believe that your content has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide ChorePay's Copyright Agent the following information:

    Identify the copyrighted work that you claim has been infringed, or if multiple works are covered by this Notice you may provide a representative list of the copyrighted works that you claim have been infringed.
